1. Acceptance of Terms

By accessing or using the Peak Power EFT application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the App.

2. Eligibility

The App is intended for users who:

  • are at least 18 years old,
  • have full legal capacity,
  • accept our Privacy Policy and these Terms.

The App is not intended for children.

3. Account Registration

You must create an account to use the App. During onboarding, you may be asked to provide:

  • first name,
  • email address,
  • password,
  • gender (for language adaptation),
  • preferred language.

You are responsible for safeguarding your login information and all activity under your account.

4. Membership & Paid Programs

The App offers:

  • membership access (e.g., generating EFT rounds on a cycle),
  • paid thematic programs.

Payments are processed through Stripe.

Refund Policy

At this time, we do not offer refunds, unless required by applicable law.

5. Non-Therapy & Non-Medical Disclaimer

Peak Power EFT is not a therapy service, does not provide mental health treatment, and is not a substitute for professional psychological or medical care.

By using the App, you acknowledge that:

  • AI-generated content does not constitute medical, psychological, or therapeutic advice;
  • the App does not diagnose, treat, or prevent any condition;
  • the App does not provide crisis support;
  • you should contact local emergency services or a qualified professional if you experience distress or safety concerns.

INHERENCE® LLC is not liable for any decisions you make based on the App’s content.

6. AI-Generated Content

The App generates personalized EFT rounds using AI models, including:

  • OpenAI (text + voice),
  • AWS Polly (backup audio).

AI output may contain inaccuracies. No results are guaranteed.

7. User Content

Your answers to onboarding questions, emotional intensity ratings, EFT rounds, and stored data are “User Content.”

You retain ownership of your User Content.

You grant INHERENCE® LLC a non-exclusive license to:

  • store it in the App’s database (Firebase, Google Cloud, AWS),
  • use it solely to generate personalized EFT content,
  • sync it within your account.

Your content is not used to train AI models.

8. Prohibited Conduct

You agree not to:

  • misuse the App,
  • interfere with systems or security,
  • attempt unauthorized access to accounts,
  • impersonate others,
  • use the App for commercial purposes without permission.

9. Intellectual Property

All intellectual property in the App, including brand elements, algorithms, logic, design, and text, is the property of INHERENCE® LLC.

9.1. Proprietary EFT Methodology and Generation Logic

Peak Power EFT uses proprietary materials, internal methods, linguistic structures, and a unique EFT generation logic developed exclusively by INHERENCE® LLC.

The content generation process incorporates:

  • original EFT rounds created by the App’s author,
  • her proprietary method of emotional work,
  • unique linguistic and therapeutic structures,
  • a custom analysis logic based on user responses,
  • an internal, protected algorithm for generating EFT sequences.

No part of this methodology may be copied, reproduced, reverse-engineered, or used to create competing products without written permission from INHERENCE® LLC.

10. Service Availability

The App may become unavailable due to:

  • maintenance,
  • outages in Firebase, Google Cloud, AWS, or OpenAI,
  • updates or technical issues.

We do not guarantee uninterrupted service.

11. Data Retention for EFT Sessions (User Content Storage Policy)

To ensure performance, system stability, and responsible data management, the App applies the following retention rules to User Content stored in your EFT library:

11.1. Inactive Sessions (Archived After 12 Months)

Personalized EFT rounds that have not been opened or played for 12 consecutive months will be moved to an Archived state. Archived sessions remain linked to your account but are not actively stored in the main production database.

11.2. Permanent Deletion After 36 Months

Any session that remains unused and unaccessed for 36 consecutive months (three years) will be permanently deleted from our systems.

11.3. What Does Not Get Archived or Deleted
  • Any EFT session that you open, listen to, or revisit during the 12–36-month window automatically resets the timer.
  • Sessions you actively engage with remain fully available regardless of membership status.
11.4. Effect of Expired Membership

If your membership expires, you retain access to all previously generated EFT sessions as long as they remain within the retention period described above.

11.5. No Liability for Deleted Content

You acknowledge that:

  • retention limits are essential for data sustainability,
  • permanently deleted sessions cannot be restored,
  • it is your responsibility to revisit the sessions you want to keep within the retention timeframe.

12. Termination

We may suspend or terminate your account if you violate the Terms or compromise the integrity or security of the App.

You may request account deletion according to the Privacy Policy.

13. Limitation of Liability

To the fullest extent permitted by law, INHERENCE® LLC is not liable for:

  • indirect, incidental, or consequential damages,
  • emotional, psychological, or financial harm,
  • the accuracy of AI-generated content.

Your use of the App is at your own risk.

14. Governing Law

These Terms shall be governed by the laws of the State of Florida, USA.

15. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.
